Sober Way Terms of Use

Sober Way (hereinafter referred to as the “Company”) provides a smartphone application, website, and related services (collectively, the “Service”).

These Terms of Use (the “Terms”) set forth the terms and conditions governing the use of the Service.

Please read these Terms carefully before using the Service. By registering for, accessing, or using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms.


Article 1 (Application)

  1. These Terms establish the conditions for providing the Service and the rights and obligations between the Company and users in connection with the use of the Service.
  2. These Terms apply to all relationships between the Company and users concerning the use of the Service.
  3. Any rules, guidelines, notices, help pages, or other provisions separately established by the Company regarding the use of the Service (collectively, the “Supplementary Rules”) shall constitute part of these Terms.
  4. If there is any inconsistency between these Terms and the Supplementary Rules, these Terms shall prevail unless otherwise expressly provided in the Supplementary Rules.

Article 2 (Definitions)

The following terms shall have the meanings set forth below:

  1. “Company” means wading.net.
  2. “Service” means the “Sober Way” application, website, and related services provided by the Company.
  3. “User” means any individual who agrees to these Terms and uses the Service.
  4. “User Information” means information provided by a User to the Company when using the Service and information obtained by the Company in connection with the User's use of the Service.
  5. “Measurement Data” means blood pressure, pulse rate, and other health-related information entered, registered, uploaded, or stored by a User through the Service.
  6. “User Data” means text, images, Measurement Data, and other data entered, uploaded, submitted, transmitted, or stored by a User through the Service.
  7. “AI Analysis” means analysis performed using artificial intelligence, algorithms, or other automated technologies based on information provided by a User or other information available to the Service, including trends, statistics, and other health-management reference information.
  8. “Automatic Recognition Feature” means a feature that uses images of a blood pressure monitor or other device to automatically recognize blood pressure values, pulse rate, or other displayed numerical values.
  9. “Paid Services” means features or services of the Service that require payment by the User.

Article 3 (User Registration)

  1. Any person wishing to use the Service shall apply for registration in accordance with the procedures specified by the Company after agreeing to these Terms.
  2. A contract for use of the Service between the User and the Company shall be established when the Company approves the User's registration.
  3. The Company may refuse an application for registration if any of the following applies:

  4. The registration information contains false, inaccurate, or incomplete information;

  5. The applicant is a minor or otherwise requires consent from a legal representative but has not obtained the required consent;
  6. The applicant has previously violated these Terms;
  7. The applicant has previously been subject to suspension of use, cancellation of registration, or similar measures by the Company;
  8. The applicant is, or is reasonably determined to be, an antisocial force or otherwise associated with antisocial forces;
  9. The Company reasonably determines that registration is inappropriate for any other reason.
  10. The Company shall not be obligated to disclose the reason for refusing registration, except where required by applicable law.

Article 4 (Changes to Registration Information)

If any registration information changes, the User shall promptly update such information in accordance with the procedures specified by the Company.


Article 5 (Management of Accounts and Passwords)

  1. Users shall be responsible for appropriately managing their user IDs, passwords, and other authentication information.
  2. Users shall not lend, transfer, sell, share, or otherwise allow any third party to use their accounts or authentication information.
  3. Except where the Company has acted intentionally or with gross negligence, the Company shall not be liable for losses resulting from inadequate management, misuse, or unauthorized use of authentication information.
  4. If a User becomes aware that their account or authentication information may have been accessed or used by a third party without authorization, the User shall promptly notify the Company and take appropriate security measures.

Article 6 (Service Content)

  1. The Service is intended to assist Users in recording, managing, visualizing, and analyzing blood pressure and other health-related information, and may provide statistical analysis, trend analysis, AI Analysis, automatic recognition, and related functions.
  2. The specific functions, availability, and conditions of the Service shall be determined by the Company and displayed within the Service.
  3. The Company may modify, add, or remove features, specifications, designs, or other aspects of the Service as reasonably necessary for business or operational purposes.

Article 7 (The Service Is Not a Medical Service)

  1. The Service does not provide medical examinations, diagnoses, treatments, prescriptions, health examinations, or any other medical services provided by medical institutions or healthcare professionals.
  2. Blood pressure values, pulse rates, charts, statistics, AI Analysis, health information, notifications, recommendations, and other information displayed or provided through the Service (collectively, “Health Information”) are provided solely as reference information to assist Users in managing their everyday health.
  3. Health Information is not intended to be used for diagnosing, treating, preventing, or otherwise making medical judgments concerning any disease or medical condition.
  4. Users shall not rely solely on the Service to decide whether to stop, delay, or avoid medical consultation or treatment, or to start, stop, change, increase, or decrease any medication or treatment.
  5. Users who have concerns or questions regarding their health, or who require medical judgment, should consult a physician or other appropriate healthcare professional.
  6. The Service is not intended for emergency medical care, emergency diagnosis, emergency disease assessment, or any other situation requiring immediate medical judgment.
  7. If a User believes that an emergency situation exists, the User should promptly seek appropriate medical assistance and should not wait for the Service to provide an analysis, notification, or assessment.

Article 8 (Blood Pressure Measurements and Measurement Data)

  1. Blood pressure, pulse rate, and other Measurement Data may vary depending on the blood pressure monitor or other measuring device, measurement method, measurement environment, physical condition, and other factors.
  2. The Company does not guarantee the accuracy, performance, reliability, or suitability of any blood pressure monitor or other measuring device used by a User.
  3. Users should take measurements in accordance with the manufacturer's instructions and recommended measurement procedures for the relevant device.
  4. The Company does not guarantee that Measurement Data entered, uploaded, or stored in the Service will always be accurate, complete, or reliable.
  5. If a measurement appears abnormal or differs significantly from a User's usual readings, the User should consider taking another measurement and, where appropriate, consult a physician or seek medical attention.
  6. Users are responsible for verifying the accuracy and reliability of their Measurement Data and for decisions made based on such data.

Article 9 (Automatic Recognition Feature)

  1. The Service may provide a feature that automatically recognizes blood pressure values, pulse rates, or other numerical values by analyzing images of a blood pressure monitor display.
  2. The Automatic Recognition Feature uses image processing, machine learning, artificial intelligence, or other technologies to recognize numerical information and does not guarantee that recognition results will always be accurate.
  3. Recognition errors may occur due to factors including, but not limited to:
  • camera angle;
  • lighting or shadows;
  • screen reflections;
  • image quality;
  • condition of the display;
  • type or model of the blood pressure monitor;
  • font or display format;
  • shooting distance; and
  • other environmental conditions. 4. Before saving or using any automatically recognized blood pressure value or other numerical value, Users should, to the extent reasonably possible, compare the result with the actual value displayed on the blood pressure monitor and verify its accuracy. 5. If an automatically recognized value is used for medical consultation, medical records, or other important purposes, the User shall independently verify the accuracy of such information. 6. Except where the Company has acted intentionally or with gross negligence, the Company shall not be liable for medical or other decisions made by a User based on the results of the Automatic Recognition Feature.

Article 10 (AI Analysis and Health Recommendations)

  1. AI Analysis provided through the Service is generated using artificial intelligence, algorithms, or automated processing technologies based on information entered or uploaded by the User and other information available to the Service.
  2. AI Analysis may contain errors, inaccurate information, incomplete information, outdated information, or information that is not appropriate for a particular User's circumstances.
  3. AI Analysis does not constitute a diagnosis, treatment, prescription, or medical advice provided by a physician or other healthcare professional.
  4. Users shall not rely solely on AI Analysis to make decisions regarding medication, treatment, exercise, diet, or other significant health-related matters.
  5. The Company does not guarantee that AI Analysis will accurately identify the presence, development, treatment, prevention, or risk of any disease or medical condition.
  6. AI Analysis may change as a result of changes to algorithms, available data, medical knowledge, system updates, or other factors.
  7. Users are responsible for determining whether and how to use AI Analysis and should consult a physician or other appropriate healthcare professional when necessary.

Article 11 (Important Notice Regarding Health Information)

  1. Reference values, evaluations, notifications, warnings, health recommendations, and other Health Information displayed through the Service may not be applicable to all Users.
  2. The meaning and appropriate interpretation of blood pressure and other health data may differ depending on factors such as age, sex, medical history, medication, physical condition, and other individual circumstances.
  3. The Service does not have access to, or assess, all aspects of a User's health condition or disease risk.
  4. Even if the Service displays “Normal,” “No Concern,” or similar results, this does not mean that the User is necessarily healthy, free from disease, or does not require medical attention.
  5. The absence of a warning or notification from the Service does not mean that the User has no disease or other health condition.
  6. Users shall not use the Service as the sole basis for deciding whether to seek medical attention.

Article 12 (Fees and Payment)

  1. Users who use Paid Services shall pay the applicable fees specified by the Company through the payment method designated by the Company.
  2. The price, subscription period, automatic renewal, cancellation procedures, and other conditions applicable to Paid Services shall be specified on the purchase screen or otherwise displayed by the Company.
  3. If a User purchases Paid Services through Apple App Store, Google Play, or another third-party payment platform, the User may also be subject to the terms and conditions of that platform.
  4. Refunds, cancellations, and payment-related matters shall be handled in accordance with the rules established by the Company and the applicable payment platform, except where otherwise required by applicable law.

Article 13 (Prohibited Activities)

Users shall not engage in any of the following activities when using the Service:

  1. Violating applicable laws, regulations, or public order and morals;
  2. Engaging in criminal activity or activity related to criminal conduct;
  3. Infringing upon the intellectual property rights, privacy rights, reputation, or other legitimate rights or interests of the Company, other Users, or third parties;
  4. Providing false, inaccurate, or misleading information;
  5. Impersonating another person;
  6. Accessing or using another User's account or authentication information without authorization;
  7. Using the Service to provide medical diagnoses, treatments, prescriptions, or other medical services;
  8. Using the Service to provide third parties with inaccurate medical information or other information that may create health risks;
  9. Conducting advertising, solicitation, promotional, or commercial activities through the Service without the Company's prior permission;
  10. Imposing excessive loads on the servers, networks, or systems supporting the Service;
  11. Engaging in unauthorized access, hacking, vulnerability exploitation, cyberattacks, or other activities that interfere with the normal operation of the Service;
  12. Decompiling, disassembling, reverse engineering, or otherwise analyzing the software, systems, or programs comprising the Service without authorization;
  13. Distributing viruses, malware, or other harmful data;
  14. Engaging in conduct that damages the reputation, credibility, or legitimate interests of the Company, other Users, or third parties; or
  15. Any other conduct that the Company reasonably determines to be inappropriate.

Article 14 (Suspension or Interruption of the Service)

The Company may temporarily suspend or interrupt all or part of the Service in any of the following circumstances:

  1. System inspections, maintenance, updates, or repairs;
  2. Failures involving computers, servers, communication networks, or other infrastructure;
  3. Unauthorized access, cyberattacks, or other security incidents;
  4. Earthquakes, lightning, fires, power outages, floods, other natural disasters, or force majeure;
  5. Requirements arising from applicable laws, regulations, governmental authorities, or other necessary circumstances; or
  6. Other circumstances in which the Company reasonably determines that suspension or interruption is necessary.

Except in emergencies or other circumstances where advance notice is impracticable, the Company will make reasonable efforts to notify Users in advance.


Article 15 (Modification and Termination of the Service)

  1. The Company may modify the functions, content, specifications, interface, pricing, or other aspects of the Service as reasonably necessary.
  2. The Company may terminate all or part of the Service for business, operational, technical, or other reasonable reasons.
  3. If the Company terminates the Service, it will notify Users in advance through an appropriate method to the extent reasonably practicable and required by applicable law.

Article 16 (Data Storage and Backup)

  1. Users should back up their Measurement Data and other important information stored in the Service as necessary.
  2. User Data may be lost, damaged, modified, or become inaccessible due to system failures, communication failures, device failures, user errors, unauthorized access, cyberattacks, or other circumstances.
  3. Unless otherwise required by applicable law, the Company does not guarantee permanent storage of User Data.
  4. Users should not rely on the Service as the sole means of storing important health information.

Article 17 (Intellectual Property Rights)

  1. Copyrights, trademarks, patents, and other intellectual property rights relating to the software, programs, designs, text, images, trademarks, logos, and other content comprising the Service belong to the Company or the respective legitimate rights holders.
  2. Use of the Service does not constitute a transfer or license of any intellectual property rights to the User except as expressly provided herein.
  3. Users shall not reproduce, modify, reproduce, distribute, sell, rent, publish, or otherwise use any content of the Service without the prior permission of the Company or the applicable rights holder.

Article 18 (User Data)

  1. Users represent and warrant that they have the lawful right to submit, upload, store, or otherwise use the data they provide through the Service and that such data does not infringe the rights of any third party.
  2. The Company may use User Data to the extent reasonably necessary to provide, maintain, improve, secure, troubleshoot, and operate the Service.
  3. The handling of User Information and health-related information shall be governed by the Company's separate Privacy Policy.
  4. The Company may process statistical, analytical, aggregated, anonymized, or otherwise de-identified information in accordance with applicable laws and may use such information for service improvement, product research, statistical analysis, and other legitimate purposes.
  5. The Company will not make a User's health information publicly available in a form that directly identifies the User, except as permitted or required by applicable law and the Privacy Policy.

Article 19 (Disclaimer of Warranties)

  1. The Company does not warrant that:

  2. The Service will meet any particular purpose or expectation of a User;

  3. The Service will always be accurate, complete, current, or suitable for a particular purpose;
  4. Health Information provided through the Service will be medically accurate or appropriate for any particular User;
  5. The Automatic Recognition Feature will always correctly recognize numerical values displayed on a blood pressure monitor;
  6. AI Analysis will always be accurate, complete, or appropriate for the User's actual circumstances;
  7. The Service will operate continuously, securely, or without errors or interruptions;
  8. Use of the Service will produce any particular health, medical, or disease-prevention outcome; or
  9. The Service will detect all potential diseases, health conditions, or health risks affecting a User.

  10. Information relating to blood pressure, diet, exercise, sleep, and other health-related matters is provided as general health-management reference information and does not constitute medical advice for any particular individual.

  11. Users acknowledge that the Service is not a substitute for physicians, medical institutions, or other professional healthcare services.


Article 20 (Limitation of Liability)

  1. Users acknowledge that the Service is intended to assist with health management and is not a medical service, medical diagnostic service, or emergency medical service.
  2. Except where the Company has acted intentionally or with gross negligence, the Company shall not be liable for medical, health-related, or other significant decisions made by a User solely on the basis of Measurement Data, Automatic Recognition results, AI Analysis, Health Information, or other information provided through the Service.
  3. To the extent permitted by applicable law, the Company shall not be liable for losses arising from errors in information entered by the User, improper measurement methods, problems with blood pressure monitors or other third-party devices, errors in automatic recognition, failure to verify automatically recognized information, failure to seek timely medical attention, or other circumstances attributable to the User.
  4. To the extent permitted by applicable law, the Company shall not be liable for losses caused by third-party services, app stores, payment platforms, network operators, device manufacturers, or other third parties beyond the Company's reasonable control.
  5. To the extent permitted by applicable law, the Company shall not be liable for losses arising from service interruptions, service termination, data loss, system failures, cyberattacks, or other technical issues, except where the Company is legally responsible for such losses.
  6. Where the Company is legally liable for damages, the Company's liability shall, to the extent permitted by applicable law, be limited to ordinary and direct damages actually incurred by the User.
  7. With respect to Paid Services, where the Company is legally liable for damages, the Company's total liability shall, to the extent permitted by applicable law, not exceed the total amount actually paid by the User to the Company for the relevant Paid Service during the twelve (12) months preceding the occurrence of the event giving rise to the claim.
  8. If any provision limiting or excluding liability under this Article is determined to be invalid or unenforceable in whole or in part under applicable consumer protection laws or other applicable laws, such provision shall apply only to the maximum extent permitted by such laws.
  9. Nothing in these Terms shall be construed as excluding or limiting any liability that cannot lawfully be excluded or limited under applicable law.

Article 21 (Third-Party Services)

  1. The Service may include advertisements, payment services, app stores, external websites, or other services provided by third parties.
  2. Use of third-party services may be subject to the terms of use, privacy policies, and other conditions established by the relevant third parties.
  3. The Company does not guarantee the content, accuracy, security, availability, continuity, or reliability of third-party services.
  4. Any contracts, transactions, disputes, or other matters arising between a User and a third party shall be resolved between the User and the relevant third party.

Article 22 (Advertising)

  1. The Service may display advertisements provided by third parties.
  2. Any purchase, contract, or other transaction arising between a User and an advertiser shall be entered into between the User and the advertiser.
  3. The Company does not guarantee the products or services offered by advertisers, except where otherwise required by applicable law.
  4. The handling of information relating to advertising shall be governed by the Company's Privacy Policy and other applicable provisions.

Article 23 (Suspension and Termination of User Access)

  1. The Company may suspend a User's access to the Service or terminate the User's registration without prior notice if any of the following applies:

  2. The User violates these Terms;

  3. The User's registration information is found to be false;
  4. The User fails to pay applicable fees without a legitimate reason;
  5. The User causes significant harm, disruption, or serious inconvenience to the Company, another User, or a third party;
  6. The User engages in unauthorized access or other improper use;
  7. The User is determined to be an antisocial force or otherwise associated with antisocial forces; or
  8. The Company reasonably determines that continued provision of the Service to the User is inappropriate.

  9. To the extent permitted by applicable law, the Company shall not be liable for losses incurred by a User as a result of measures taken under the preceding paragraph, except where the Company has acted intentionally or with gross negligence.


Article 24 (Withdrawal and Account Deletion)

  1. Users may withdraw from the Service in accordance with the procedures specified by the Company.
  2. Any outstanding fees or other obligations owed by the User at the time of withdrawal shall remain payable.
  3. For subscription services purchased through Apple App Store, Google Play, or another third-party platform, Users may be required to cancel the subscription through the procedures specified by the relevant platform.
  4. The handling of User Information after withdrawal shall be governed by the Company's Privacy Policy.

Article 25 (Handling of User Information)

  1. The Company's handling of User Information shall be governed by the Company's separate Privacy Policy.
  2. Users should review and understand the Privacy Policy before using the Service.
  3. Blood pressure, pulse rate, and other health-related information shall be handled in accordance with applicable laws and regulations and the Company's Privacy Policy.
  4. By using the Service, Users agree to the Company's handling of such information in accordance with the purposes and methods described in the Privacy Policy.

Article 26 (Amendments to These Terms)

  1. The Company may amend these Terms as reasonably necessary due to changes in applicable laws or regulations, changes to the Service, technological developments, or other circumstances.
  2. When amending these Terms, the Company will notify Users of the amended terms and their effective date through the Service, the Company's website, email, or another appropriate method.
  3. Where User consent is legally required, the Company will obtain such consent in accordance with applicable law.

Article 27 (Communications and Notices)

  1. Communications and inquiries from Users concerning the Service shall be made through the methods designated by the Company.
  2. The Company may send notices to Users through in-app notifications, email, website announcements, or other appropriate methods.
  3. Notices sent to a User's registered email address or other registered contact information shall generally be deemed delivered when they would ordinarily be expected to reach the User.

Article 28 (Prohibition on Assignment)

  1. Users may not assign, transfer, pledge, or otherwise dispose of their contractual position or any rights or obligations under these Terms to any third party without the Company's prior written consent.
  2. If the Company transfers the business relating to the Service to a third party, the Company may transfer the contractual position, rights and obligations under these Terms, and User Information related to the Service to the business transferee to the extent permitted by applicable law.

Article 29 (Severability)

If any provision of these Terms, or any portion thereof, is determined to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.


Article 30 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. Any dispute arising out of or relating to these Terms or the Service shall, to the extent permitted by applicable law, be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
  3. If applicable law grants consumers the right to bring proceedings before another court or otherwise restricts the effectiveness of an exclusive jurisdiction clause, such mandatory provisions shall prevail.

Supplementary Provision
