Sober Way Terms of Use

These Terms govern your use of the Sober Way app, website, and related services (the "Service") provided by wading.net ("we" or "the Company"). By using the Service, you agree to these Terms.

1. Service purpose

The Service helps you record sober moments, cravings, drinking events, reminders, alternatives, and personal progress. You decide what to record and whether to use each feature. The Service does not require total abstinence and does not treat a drinking event as erasing prior progress.

2. Accounts and user data

You must provide accurate information needed for an account and protect your authentication details. You retain rights to information you submit. You grant us the limited permission needed to store, process, display, synchronize, secure, and operate the Service with that information.

Do not submit information you have no right to use, or use the Service to harass, mislead, harm, or violate another person's rights. We may suspend access when reasonably necessary for security, legal compliance, or serious misuse.

3. Health and safety disclaimer

The Service is not a medical device and does not provide diagnosis, treatment, prescriptions, emergency assistance, or professional medical advice. Body recovery milestones, statistics, reminders, suggestions, and other content are general reference information and may be incomplete or inaccurate. Do not use them as the sole basis for medical decisions. Consult a qualified professional about health concerns, and seek emergency help when necessary.

4. Purchase

The Service may be offered as a one-time purchase for 680 JPY. Prices, availability, taxes, payment processing, and refunds are governed by the applicable app store and purchase screen. This purchase is not an automatically renewing subscription unless a separate purchase screen clearly says otherwise.

5. Alternatives and community interactions

Alternatives and other user interactions may reflect personal experiences and are not medical or professional recommendations. We do not guarantee that an alternative is suitable, safe, or effective for you. Do not use the Service to encourage dangerous consumption, self-harm, illegal conduct, or unsafe treatment.

We have zero tolerance for harmful or prohibited content and malicious user behavior. You must not publish or distribute illegal, threatening, harassing, hateful, fraudulent, sexually explicit, violent, self-harm-related, spam, privacy-invasive, or otherwise harmful content. You must not impersonate others, manipulate interactions, abuse features, evade platform safeguards, or otherwise use the Service maliciously. We may remove content, restrict features, suspend, or terminate an account without prior notice, and may take further action where permitted or required by law.

When you choose to publish a submission, the submission text may be sent to OpenAI's moderation API for automated safety review before publication. OpenAI processes the data it receives under its applicable terms, privacy policy, API terms, or services agreement, which may change when OpenAI updates them. Automated moderation can be inaccurate and is not a human or medical determination. Do not submit content you are not authorized to provide, content that may not lawfully be disclosed, or unnecessary sensitive information. You must have the rights and permissions needed to submit the content and permit this review. OpenAI is an independent third-party service provider; nothing in this section excludes liability that cannot legally be excluded.

6. Availability and changes

We may update, suspend, or discontinue features for maintenance, security, legal, or operational reasons. We do not guarantee uninterrupted availability, permanent storage, or that every record can be recovered. Keep independent copies of important information.

7. Intellectual property

The Service, including its software, design, text, marks, and original content, belongs to the Company or its licensors. You may use it only as permitted by these Terms and applicable law. You may not reverse engineer, misuse, copy, or redistribute the Service without permission.

8. Liability

To the extent permitted by law, the Service is provided on an as-is and as-available basis. We are not responsible for losses caused by inaccurate user input, reliance on reference information, interruptions, device failures, or events outside our reasonable control. Nothing in these Terms limits liability that cannot legally be limited.

9. Account deletion and termination

You may request account deletion through the app or by contacting support. We may terminate or restrict access for a material breach, abuse, security risk, or legal requirement. Terms that should continue by their nature, including intellectual property, disclaimers, and payment obligations, survive termination.

10. Contact and changes to these Terms

Questions about these Terms may be sent to support@wading.net. We may update these Terms by posting a new version with its effective date. Continued use after the effective date means you accept the updated Terms.
